Brazil family reunion visa denied.

Hello Everyone.


on October 12th 2022 I married a Brazilian lady

The wedding took place in Pakistan, after we registered at the Brasil embassy Islamabad , ​​& she returned to Brazil, transcribed it into Portuguese, with a sworn translator.

She performed all the legal procedures in the notary offices, notes and civil.

She forwarded all the documents to me, & I was applied for the family Reunion Visa

It was denied the first time.

Again I was applied 2nd time again denied.

I would like to know if I have any chance of getting my visa here in Brazil through Immigration Attorney Lawyer.

since our age difference is reasonable, she is 57 year old & I'm 28 kindly tell me how much chances of my Immigration application will be Grant.

04/29/23 @Mantarali99.  It's  unfortunate that your wife didn't stay to go with you to apply for your VITEM XI:  the Consulates really, REALLY want the  Brazilian spouse to be present for that, and if s/he is, the visa process usually goes smoothly.  If she had been present and they could have spoken with her, there probably would have been no problem.  In her absence, your age difference may have  been an additional red flag,  but it would have been hard to be approved even if you were the same age.


If your wife returns to Pakistan and goes with you to the Embassy to apply for your visa, it will probably be approved.  If you come to Brazil legally, or are already in Brazil legally, with the help of an attorney and the active support of your wife the Polícia Federal should approve your Authorization for Residency on the basis of Family Unification.  The active support of your wife is key.


If you're in Brazil illegally, you need an attorney ASAP, first to regularize your status, then to convince the Polícia Federal to let you stay.

@abthree Appreciated. In embassy it's working pakistani staff they're very harsh rude they're saying it's not our hand as well they said it's a sovereignty of Brazilian government. If I invite my wife how much chances of getting visa is there any confirmation....????

04/29/23 @Mantharali99.  There are never any guarantees with any embassy, anywhere, but your wife's being there would be a game-changer. The Pakistani staff probably has standing orders to reject young Pakistani men who claim to have Brazilian wives who are already in Brazil:  it's a claim that they hear a lot.   Just her presence would put you in a different category for them.  She should do the talking, and she should do it in Portuguese.   If they're still uncooperative, she can do something that you can't:  demand, as a Brazilian citizen, to speak with a Brazilian consular officer.

Family Reunions work differently in Brazil from the US, as far as my layman's knowledge goes. 


In the US , you could be approved after a lengthy process, and they would still require  a follow up  interview with the   sponsored groom  or bride.  Mail Order Brides, Green Card arrangements are a common place there. So INS officials follow through  what's on their plate of cases to avoid being taken advantage off.


With Brazil, there is the presumption of foul play,  under the general assumption this might be an arranged marriage. In Brazil you are presumed guilty until proved innocent, and in the US, theoretically, is the other way around. 


Brining the wife to your country to lead the interaction with Brazilian Consular staff is a better way to deal with this, as others here suggested.    You can fill as many form as you wish, beat your drum as loud as you could, make as many inquiries as you desire, and yet, your application status would go nowhere. 


Besides, you have no pull on the Brazilian side of what is their sole prerogative.  Whether you are bound to Brazil or the US, having an insider track makes all of the difference in getting your application speedier review.


  And chances are, if you picked up your wife out of some online exchange or a straw hat, she has no connections either. She is disfranchised as you might be. Two peas in the pod, and not a lot more to it.


In the US, if I had some relationship or belonged to a Congressional District,  and I being an active party delegate, or activist, my representative staffer would make a few calls in my behalf, and things might get sorted in my favor.     In Brazil, Congressional Votes are not District based, they are a-large, so her chances with her Congressman are as good as any, meaning Zero favors to be cashed out and granted to her. 


Historically speaking , Brazilian Immigration policies only allow the floodgates wide open when there is an acute labor shortage in the Country.   And the last we had was somewhere between when slavery was abolished and up until after WWII when the Country went into industrialization overdrive. 


All others that came in here afterwards, did so  through either illegal or humanitarian refugee grants, and in terms of contingent, goes, they   were token sized immigration initiatives.


if they start letting a few  Pakistani or Afghani emigres, they could unwilling open the floodgates to more than they would be willing to grant legal residence. And I am sure they don't want that.


And I doubt  Brazilian public  officials haven't been notified of any demographic imbalance that might threat the Country's economy to the point of allowing the gates open.


I told this before, ...... Ditch the Brazilian one, and get yourself a Russian one. I was not kidding.

If you're Canadian, your spouse is Brazilian, the marriage is in person and NOT by proxy, and you meet all the requirements outlined on the Brazilian Consulate website, you should not have any trouble.  As I said to the original poster (OP), the Brazilian spouse should be present at every meeting with Brazilian officials, particularly the early ones, if at all possible.


Please note that Canada will not be an active party to the Apostille Convention until next month, so all Canadian documents will need to be legalized at a Brazilian Consulate in Canada until that change is completed.

@abthree canada does not recognize marriage by proxy. I was married in Brazil, in person.


The Brazil embassy in Vancouver doesn't allow in person visits anymore at all. Everything is done online and via mail. It wouldn't make any difference if she was in Canada or not. If they had questions they would call her.


That is what the embassy told me.

12/07/23 @Canforbra.  That's good:  Brazil is VERY hard over on proxy marriages, and I don't think that there's any way around that prohibition.  If you have a Brazilian Marriage Certificate, you should be fine.  Please let us know how it goes.
