Question About Spousal Exemption from Work Permit Exemption

I'm trying to get paperwork set up properly in compliance with Vietnamese labor laws to do work for my wife's company.  We are using a paid service to submit the application to the government.


At the bottom of this message I've posted some Vietnamese instructions I have and a translation from Google. 


There are two steps we need to complete.  First, my wife's company needs to get permission to be able to hire foreign employees at all.  We finished that step.  Second, my wife's company must notify the Department of Labor, War Invalids and Social Affairs at least 3 days before the work start date with the following information about the employee:"- First and last name;- Years old;- Nationality;- Passport;- Employer's name;- Work start and end date." 


My understanding is spouses of Vietnamese nationals are not only exempt from the work permit, but they are not required to get the work permit exemption either.  The only requirements I can find are what I alluded to already, sending notice to the DoL of xy and z.


We are running into problems with the paid service on the second step.  They said the government office now wants health checks.  I asked where this requirement is posted, they told me the governemnt office makes this request verbally with them, it's not posted anywhere.


During my previous employment elsewhere I was also required to get a health check.


Has anyone completed this process?  Could you please share your own experience?

"Dossier of application for certification of free work permit

Pursuant to the provisions of Clause 3, Article 8 of Decree 152/2020/ND-CP, the required documents to request a resolution to confirm the free attribute of a work permit include:


(1) A written request for certification of papers not falling within the competence to issue a work permit, made according to Form No. 09/PLI, Appendix I of this Decree.


(2) Certified copy of valid passport.


(3) Certificate or Medical Examination Certificate from a foreign or Vietnamese medical facility, provided within 12 months, up to the time of the preliminary application.


(4) Written consent upon request for foreign use except in cases not specified as such.


(5) Papers to prove management are not subject to licensing.


Note, document types (3), (4) and (5) must be updated with the original or a certified copy. Schools issued by institutions with foreign degrees must be legalized, translated into Vietnamese and have proof


2. Order and procedures for certification

Pursuant to account 1, account 2 and account 5, Article 8 of Decree 152/2020/ND-CP, the deliberation procedure for certification of work permit exemption shall be conducted in the following order:


- The employer's application file is certified at the Department of Labor, Invalids and Social Affairs at least 10 days before the expected time the employee starts working. Except in cases where only reports are required.


- Within 05 working days from the time of receiving the complete application, the receiving agency shall issue a written confirmation that the employee is not eligible for a work permit (hereinafter referred to as the confirmation document).


- The maximum duration of the written certification shall not exceed 2 years.


3. Cases that do not have to undergo certification procedures but only need to be reported to the Department of Labor, Invalids and Social Affairs

Zone 2, Article 8 of Decree 152/2020/ND-CP stipulates a number of the following reasonable cases where the application for certification is not required but only needs to be reported to the Department of Labour, Invalids and Social Affairs:


- Entering Vietnam with a term of less than 3 months to make a service offering.


- Being a foreign lawyer who has been granted a license to practice law in Vietnam.


- Foreigners marrying Vietnamese and living in Vietnamese territory.


- Being the owner or capital contributor of a limited company with contributed capital of 3 billion VND or more.


- Being the Chairman or member of the Board of Directors of a joint-stock company with a contributed capital of 3 billion VND or more.


- Working in the position of a manager, executive director, expert or technical worker for less than 30 days and no more than 03 times in a year.


- Relatives of members of foreign representative offices in Vietnam.


At least 03 days before the expected time the employee enters the job, the employer must notify the Department of Labor, War Invalids and Social Affairs the following information about the employee:


- First and last name;


- Year old;


- Nationality;


- Passport;


- Employer's name;


- Work start and end date."




"Hồ sÆ¡ Ä‘á» nghị xác nhận được miá»…n GPLÄ

Căn cứ theo quy định tại khoản 3 Äiá»u 8 Nghị định 152/2020/NÄ-CP, những tài liệu cần có để Ä‘á» nghị xác nhận thuá»™c diện được miá»…n GPLÄ bao gồm:


(1) Giấy Ä‘á» nghị xác nhận NLÄ không thuá»™c diện cấp GPLÄ theo Mẫu số 09/PLI Phụ lục I Nghị định này.


(2) Bản sao có chứng thá»±c há»™ chiếu còn thá»i hạn.


(3) Giấy chứng nhận hoặc Giấy khám sức khá»e do cÆ¡ sở y tế của nÆ°á»›c ngoài hoặc Việt Nam cấp trong vòng 12 tháng, tính đến thá»i Ä‘iểm ná»™p hồ sÆ¡.


(4) Văn bản chấp thuận nhu cầu sá»­ dụng NLÄ nÆ°á»›c ngoài trừ những trÆ°á»ng hợp không phải xác định nhu cầu này.


(5) Các giấy tỠđể chứng minh NLÄ không thuá»™c trÆ°á»ng hợp phải cấp giấy phép.


LÆ°u ý, các loại tài liệu (3), (4) và (5) phải ná»™p bản gốc hoặc bản sao có chứng thá»±c. trÆ°á»ng do cÆ¡ quan có thẩm quyá»n của nÆ°á»›c ngoài cấp thì phải được hợp pháp hóa lãnh sá»±, dịch ra tiếng Việt và có chứng thá»±c


2. Trình tự, thủ tục đỠnghị xác nhận

Căn cứ theo khoản 1, khoản 2 và khoản 5 Äiá»u 8 Nghị định 152/2020/NÄ-CP, thủ tục Ä‘á» nghị xác nhận được miá»…n GPLÄ tiến hành theo trình tá»± sau đây: 


- NgÆ°á»i sá»­ dụng lao Ä‘á»™ng ná»™p hồ sÆ¡ Ä‘á» nghị xác nhận tại Sở Lao Ä‘á»™ng, ThÆ°Æ¡ng binh và Xã há»™i trÆ°á»›c thá»i Ä‘iểm dá»± kiến NLÄ bắt đầu làm việc tối thiểu 10 ngày. Trừ những trÆ°á»ng hợp chỉ cần báo cáo.


- Trong vòng 05 ngày làm việc, kể từ thá»i Ä‘iểm nhận đủ hồ sÆ¡, cÆ¡ quan tiếp nhận có văn bản xác nhận NLÄ không thuá»™c diện cấp GPLÄ (gá»i tắt là Văn bản xác nhận).


- Thá»i hạn của Văn bản xác nhận tối Ä‘a không quá 02 năm.


3. Những trÆ°á»ng hợp không phải làm thủ tục xác nhận mà chỉ cần báo cáo cho Sở Lao Ä‘á»™ng, ThÆ°Æ¡ng binh và Xã há»™i

Khoản 2 Äiá»u 8 Nghị định 152/2020/NÄ-CP quy định má»™t số trÆ°á»ng hợp sau đây không phải ná»™p hồ sÆ¡ xin xác nhận mà chỉ cần báo cáo cho Sở LÄTBXH:


- Vào Việt Nam vá»›i thá»i hạn dÆ°á»›i 03 tháng để thá»±c hiện chào bán dịch vụ.


- Là luật sư nước ngoài đã được cấp Giấy phép hành nghỠluật sư tại Việt Nam.


- NgÆ°á»i nÆ°á»›c ngoài kết hôn vá»›i ngÆ°á»i Việt Nam và sinh sống trên lãnh thổ Việt Nam.


- Là chủ sở hữu hoặc thành viên góp vốn của công ty TNHH với vốn góp từ 3 tỷ đồng trở lên.


- Là Chủ tịch hoặc thành viên HÄQT của công ty cổ phần vá»›i vốn góp từ 3 tá»· đồng trở lên.


- Làm việc tại vị trí nhà quản lý, giám đốc Ä‘iá»u hành, chuyên gia hoặc lao Ä‘á»™ng kỹ thuật có thá»i gian làm việc dÆ°á»›i 30 ngày và không quá 03 lần trong 01 năm.


- Thân nhân thành viên cơ quan đại diện nước ngoài tại Việt Nam.



Ãt nhất 03 ngày, trÆ°á»›c thá»i Ä‘iểm dá»± kiến NLÄ vào làm việc, NSDLÄ phải báo cho Sở LÄTBXH những thông tin dÆ°á»›i đây vá» NLÄ

Hi Mike!


Such a shame this is so complicated.


I honestly don't know irrefutable answers to your questions, but based upon the general understanding that I had previously, I'm wondering two things:


1. If your wife's business isn't too large (I don't know what "too large" is) did you consider going into the local police station to find out what they would require?


Somewhere back in the forum I seem to recall someone saying that's what what they needed to do to get permission to take a certain job in a situation such as yours.


I'm pretty sure that thread was created after the law was changed easing the restrictions for foreign spouses here on TRCs.


2. How old are you?


Not really any of my business but I'm wondering if age played a factor in requiring the health check.


Thanks for starting such a great and concise thread.


Hopefully it will someday evolve into a sticky thread on this subject.

@mtgmike hello, what I understood about your question: Your wife is a vietnamese citizen and you want to work in the sam company with her. If that is your case, to work is not complicated. As a husband of a vietnamese citizen you are a member of a Viet Family and Vietnam will also protect you.


Fact: "To be exempted of WP" is not the same as "Not to be requested for WP". Companies only need to notify you will work with them.


Fact: You must live in a stable and long term in Vietnam, so if you are still using a Tourist Visa or VEC you cannot work here. This means you need at least a Visa for 6 months or TRC or PRC.

With these precedents, You only need:


1)to fill out the FORM 09/PL1 (this is the notification)

2)The request to employe a foreigner

3)Notarized copies by a vietnamese notary (and no more than 3 months since notarized) of:

    - Company license registration

    - Your passport (all pages)

    - Marriage certificate (issued in Vietnam, right?)

    - Your wife's citizen ID (the new one)

    - 2 pictures 3x6

The Health Certification is not required, but in case it is nice to have,  quite easy and fast (2 hours) to get from a Hospital (Samples of blood, pee, poop, eyes, lungs xrays, teeth, ultrasound of kidneys, stomach and liver)
