Housing Tax / Taxe d'Habitation

Good morning

Does this tax (Housing Tax / Taxe d'Habitation) apply to all foreign buyers who buy real estate in France, even though it is a sole/ only residential property in France ? I do not well understand if this tax applies to anyone living in France, whether they are French or foreign owners, who own a second and more residential property.

As far as I know, the tax d'Habitation applies to everyone.  There was a new law a few years ago that said that if it is your primary home (and you can prove it), you do not pay this tax. (You only pay taxe foncière)


Also, if this home is rented and it can be proven that your renter was there on 1st January, then they will be the one needing to pay this tax.  I know of a case where the apart was empty but there was proof that it was advertised to be rented, and the taxe d'habitation was waved for that year.

Hello, and first of all thank you so much for your communication. I am new on this site. I think that I need further help in this matter. 

It is my first time that I have purchased a property abroad which property is in northern France, and it is the only property that I own in France.  The property needs considerable repairs as it is quite old, most probably over 200 years old.  I am not yet living there all year round. The fact that at the moment I reside in another E.U. country, does this affect in any way that the property/ property owner in France is not exempt from Tax d'Habitation?

Hello again,

I don’t believe that it’s important if you are in France or elsewhere.

As far as I know, you are the one that will have to pay la taxe d’habitation for this place, unless you have a way to “prove” that it is your primary residence.

In my opinion you can always try and see what happened. 

Pay it first, then request for a waiver and supply them with the documentation.
