My company is not giving me final exit after accepting my resignation

Hello Friends,

I am working here in Riyadh Saudi for last 14 months and I have a contract for 4 years with my company and I got recruited to work in software development and after joining the company the company purchased a new software/technology and informed us we'll provide one month of training and you need to work on this and they didn't give the full training hardly 5 days training they gave in this new technology which even I didn't know before coming here , and the company told me to learn and do it and they hold my half month salary initially for not delivering the work and I told them I don't know this technology and I'm not ready to work I'm resigning from my job .

They told no we can't accept your resignation you've to work anyhow as you've signed the contract I told them that it'll take time for developing these applications as I need to learn and develop they told OK you take your time and develop whatever possible .

OK . Last six months I learnt and developed few applications and delivered which they accepted and using it . After they gave one complex application to develop which I took 2 months to develop as I don't have expertise in that technology and for this they given me penalty of 3000 SAR my half month salary .

I told them as you know I don't have any prior experience in this technology and I'm learning and doing it and this is a complex requirement I can't finish it , and they told if you don't know resign your job and leave .

I asked them for my penalty amount to get returned that is the 3000 SAR they didn't give and I resigned they accepted it and they stopped me immediately from work without giving any notice period .

And told me we'll process your final exit and you need to pay the expenses for your visa iqama and insurance something around 5000 SAR , I told them OK but I need my final exit faster anyhow .

And they didn't pay my salary last month they paid only 50 SAR as salary last month and I'm sitting in room for last 16 days.

And now they're saying we can't give final exit you need to complete the work then we'll give the final exit .

Officially they've stopped me from job and no salary is calculated for me and after accepting my resignation they're not giving me my final exit and asking me to work .

I don't know how to handle this situation , I need to go on exit anyhow as I don't want to work here anymore as I don't know the technology they're asking me to work and I came here for different technology .

And I'm planning to approach my embassy to get involved in this and get me the exit .

Best thing to do is go to Ministry of Labor and put a case there. From what i have been told by them,  the ministry have the power to send you on exit (after you put a case against them and after the 1st hearing). but you will need to have a relative to follow up the case and get your rights from the company.

Thank you for your reply , but I'm little bit concerned about the time it'll take if I put a case against them as many of the employees are saying it'll take minimum 6 months to get settled . I can't survive here that much long period without job and all .. I'm very much confused actually how long it'll take to get settled .

If you want to get whatever salary they are holding, then that will indeed take time. However as a mentioned earlier, after putting up the case then you can have someone represent you while you go on exit.

I am not sure what the embassy will say/do, so do give them a visit and find out. Unfortunately, doesn't look like we have much options!

Do you have a document to prove that they asked you to stop immediately without notice?

Yes , I have the copy of submitted resignation letter with effective date as well as the HR gave me the copy of the Administrative Decision they used to roll out in the company in the case if a guy goes on exit,


and the HR gave the confirmation that your account closed from the effective date specified in the document.

both the documents are in Arabic .

I'm little worried as here the HR department is for namesake and the decision is made by the Finance Manager of the Company and i can't  meet him as he doesn't give appointment.

and here i don't even need my pending salary or money but i need my exit to go back to India as early as possible as i'm going through tough time.

again i have requested them to process the exit and planning to wait some more time meanwhile will check with the embassy as well i called them and explained all these situations they told come with your contract copy and sponsor details to meet the labor officer in embassy he'll guide you to handle this .

Dear bro,
My iqama profession is different from my work.Company is paying me in accordance with the previous designation that is written on contract letter. salary of my other fellows has been increased but he didn't increase my salary.I also have health related issues for which I have medical certificate but he still neither is giving me leave for home country nor increasing salary.He took extra tasks from me for 10 months and didn't pay for that extra tasks..I sent him letter not to renew mu iqama but still he renewd.I have spent 14 months here.Don't wanna stay anymore with him..suggest me what do I need to do?
