Divorcing in Kuwait

Post new topic

Hello everyone,

Reaching the decision to seek divorce can be hard. Filing the papers as an expat in Kuwait can be as taxing since a good grasp of legislations is needed and the process can prove to be tedious.

Where and how do you apply for a divorce in Kuwait? How long does it take for the process to be completed?

If the couple has children, which measures can be taken in order to protect their interests?

Which procedures should be completed so that the divorce is legally recognized in the country of origin?

How is divorce viewed in Kuwait?

Being away from one's home country and loved ones, what advice do have for staying strong emotionally and mentally in this situation?

Thanks for sharing your experience.

Hello,Diksa,
I hope my msg finds you well.
In Kuwait, just as about anywhere else,
getting a divorce from s not an easy decision,
especially if initiated by a woman.
Regretfully , We-women today , live in a mens’ world ,
just as much ,as our brave female ancestors , fighting for our equal rights around the world.
In Kuwait ,there are not so many different rules or procedures to follow.
Unfortunately (for our pockets) , they all require a lawyer to initiate.
Lawyers in Kuwait tend to be costly.
But it’s the only way to finish fast and make it as painless , as possible for all the family.
Regarding children , as long as they are foreigners,
Kuwait is not so much concerned with their rights ,as foreign law would apply.
However, the children won’t be able to leave Kuwait, without their father ‘ s written permission.
It’s advisable to obtain his written note , stamped by the embassy of your home country ,prior travelling.
When and if the children are Kuwaiti citizens, then Kuwaiti law will apply in court.
Always remember-divorce is just a paper you will get , but the actual consequences of it-you will bear forever-think 10 times before divorcing.
Unless ,an abusive husband ,then -seek help and pride.

The marriage contract should have very clear provisions about divorce.  Kuwait law would say follow the contract.
It is only complicated if the contract says nothing. then people have to argue about what to do.
