How long can we be out of brazil with CIE

Post new topic

philmoto85

I forgot. How long can we be out of Brazil before we risk losing our CIE?? 12 months? 18 months? I would come down for a little bit but Obviously is not possible because of COVID

Thanks

abthree

As long you don't wait past 24 months between visits to Brazil, you're fine.  Since you're married to a Brazilian, you'll also be let into the country, even with most foreigners locked out.

Kindly advise.  I have a Brazilian child and my viper, but have stayed out for 28months . I plan to return August, will i be allowed entry at the airport, and then re-apply in Brazil?

Please consult with the nearest Brazilian Embassy/Consulate where you live.

I have the same dilemma. I brought my wife to the USA for better Cancer Treatment. It was 2 years on July 3rd. I know I am past the 2 years. We also held off because of the COVID 19 I am hoping it won't be difficult to get it back and that I can enter with it being overdue. I do have a tourist visa that has not yet expired but I'm not sure it is valid anymore since I have the CIE. If anyone there hears if they are extending due to COVID 19 I would appreciate hearing.

Thanks, Jim

Jim,

What I saw as suspension of expirations of documents at the PF site was for people stranded inside Brazil. But then again there was a couple - a Brazilian woman married to an Irishman who were planning to move to Brazil permanently who called the PF if they need to do new documents because theirs was expiring due to delays caused by COVID-19. The PF answer: No need. I don´t know if they would also extend that to other circumstances like your case. So it depends on who´ll interpret it as there are flights from the USA to Brazil and you´re not banned to go back to Brazil anytime since you´re a permanent resident and also married to a Brazilian.

You should e-mail the Brazilian consulate nearest you.

My wife sent an email to Federal Police concerning our situation and got this reply which I translated to English. This may help others.
Dear,

The immigrant who stays more than two years outside the country may lose his / her residence for an indefinite period because he/she is absent from the country for a period of more than two years without presenting a justification.
After proceedings have been initiated for the loss of residence for an indefinite period, notification to the immigrant will be made, preferably by electronic means, for the presentation of the defense, within ten days.

However, due to the pandemic and in view of the global difficulty of displacement, the counting of the maturity of documents and migratory situations were suspended on 03/16/2020.

Upon returning to Brazil, the foreigner will be notified of his condition, if necessary.

Jim,

Great!  Looks like a good answer, and that you're in the clear.  At worst, someday you may have to go to the Federal Police and say the magic word, "covid!" -- but probably not even that.

I hope that all is going well with you and your wife.  Best wishes always.

Airline check-in employees only verify the expiration date of your RNE/CRNM and don´t look into passport stamp expirations of overseas stays, so you should be able to board a flight back to Brazil...
I recommended a Brazilian consulate also because of that but I hope everything is fine.

Hi Jim:

I had another post related to being outside Brazil over two years and you also saw it some weeks ago. I spoke with my wife’s cousin at the time who works at the PF in Vitoria ES. He recommended for specific questions to send an email to the local PF office which you did so I would think your all set.

I don’t know specifically how they’ll handle it when the ban is lifted. I’m hoping if the clock stopped ticking in mid March then they will sum the total days after the clock starts again and add that to our original two year date. Who knows? That would be too simple for a Brazilian government entity 🙃.

Anyway, I’m assuming your wife is Brazilian, so even with just a passport (US citizens don’t need visas anymore) you can enter as there is an exception to the current ban for spouses of Brazilians.

Just an FYI for anyone who plans to go to Brazil during the ban, one needs some sort of official note stating your not currently infected to board a plane to Brazil.

Excerpt from Ban DOU in English.

“The passenger must, before boarding, present to the transport company a medical declaration issued by a local health authority or doctor who attests that he is not infected with the SARS-CoV-2 coronavirusâ€

Cheers,

Tim.

I have permenant status indefinitely  and no longer need to renew my residency. Does this 2 year out of the country rule apply to me.?

In principle, it does.  There have been some indications here - all anecdotal - that cancelations aren't automatic,  but depend on the PF opening a cancelation process.   I probably wouldn't depend on that myself, but there may be some leeway.

bepmoht

Yes it does. I also have permanent residency with no expiration. (Validade Indeterminada). Everyone who is a permanent resident cannot stay outside Brazil for over two years without touching Brazilian soil 😀. That’s the rule.

Cheers,

Tim

Hi there, can anyone remind me whether the two years is from my last date of ENTRY to Brazil or EXIT? I last entered the country on Aug. 11, 2019, and exited on Sept. 1, 2019. I’m wondering which is the deadline, and also whether there has been any relaxation of this rule in light of COVID. Hoping I can get a vaccine in time to make my deadline next summer!
Thanks!

Texanbrazil

From the exit date. Brazil has stopped the COVID extension days.
All the required 24 months apply.

Isn't there an age cut-off point after which RNE or CRNM's no longer expire?

abthree

After age 60, they're replaced with cards that no longer expire or need to be renewed.  They can still be canceled if the holder is absent for over two years, however.
