@MS10_07 Hi, I had a question maybe you can answer. I have a job currently but my last date is end of December. My current residence permit is valid till end of January. Am I allowed to stay in Belgium without a job till I get the Annex 46? I have also applied for Brussels and got WP on 19th-oct but just got information from my new employer that immigration office told them it will take 1 more month for delays and christmas. I ask you, bc i am assuming you are no longer a student. Thank you in advance.

it is really frustrating since I was asked to resign from my current organization upon receipt of work permit.

Hi!

Yes, it's perfectly fine to stay in Belgium, you have the residence permit until January and since your new work visa application is in process, you can live in Belgium. I think you might even get annexe 46 before the end of January (your RP is valid until 31 Jan I assume).


But, if you feel that the process is taking time and will not arrive on time, you can visit the commune (in the last 15 -20 days of January) and can get an annexure which is equivalent to a residence permit card (temporary residence permit) which will be valid until you receive annexe 46 (or the new RP card). They ask for your current RP and the work permit decision.

If you want to obtain this temporary RP Make sure that you visit the commune before the current RP expires (last 15-20 days of January)


In my case, I was not able to obtain this temporary RP, since my student RP was already expired. However, the public servant at the commune said that as my case is with the migration office, I can still stay in Belgium until they make a decision on annexe 46.

Yes, I received the work permit already on October 14.

But I was not able to start working, I was supposed to start on December 1 but as annexe 46 didn't arrive I have to wait.


Application send: 6 October

No-reply: 6 October

Application accepted (WP) & sent to Immigrations for processing: 14 October

I am not sure if this is the general case or not.

I was applying for a single permit for the first time, as earlier I was on a student visa. But maybe, it's different if you are just renewing the work permit, then maybe you can start working without a new RP. And furthermore, in my case, I currently do not have a valid RP (even the temporary one annexe 49 or something). So, probably that's the reason I couldn't start.

My employer submitted my documents on October 6, and my file is already at the immigration office. However, I have not been able to start working as this is also my first application. I reside in Belgium as well.

@MS10_07 I am in the same situation as yours. My student RP is expired and I applied for a new one to be able to work. Thank you for explaining we can stay until Immigration Office has a response. Do you may know if the expired RP can have a problem regarding the application for the new RP?
