Gratuity/settlement amount not giving by company

I resigned from job, as per company rule I have completed 3 month notice period. As company not get the replacement of mine during my notice place,  and in goodwill I spend more 4 month. Now when I am asking for Gratuity/settlement amount, company stating that there is no fund.

As they are insisting me to fly home country & once company received the fund they will transfer. But I dont have faith on them.
My visa is also expired.

In this case would you please guide me.

Hi,

As per the Labour Law of Oman, you are entitled to receive at the expiry of your notice period -

1. any outstanding salary

2. gratuity

3. encashment of remaining annual leave

4. any commission or pay as agreed under the employment agreement

5. experience certificate

6. return ticket

7. any other outstanding amount due to the employer.

Thus, if your company does not give you the entitlements as enumerated above, you can LAWFULLY claim them by registering a complaint to the Ministry of Labour. In case it is not settled, it will be escalated to the labour court. I would suggest if you decide to leave Oman (as living here without job is not financially conducive), you better issue power of attorney to a lawyer in Oman before you leave to represent you in the case.

How can a person with no job currently have money in hand to hire a lawyer?? Is there no other way??

Unfortunately very common in Oman. Take whatever you can and leave the country. Otherwise it can months or years to go to court but there is a special section in Ministry of Labor in Oman supposed to handle such cases
