Want to cancel contract and go back to India

I came here on the 4th of July on a work visa. Still, I  had not completed 3 months here.  My contract mentioned that I will be on a probation period for three months.  Last week I had an issue with the company and because of that, I want to leave this company and want to go back to my country. My company is now allowing me to go back and not excepting my resignation.


Please advise me on what to do now.

once you & your company signed on contract on mutual agreed terms and conditions, both should obey the contract. During probation both parties can take decision. You can complaint in Ministry of labor office and explain them your situation. But, better you should negotiate with company HR/ Management directly.

The second party shall be under probationary period of 90 days

beginning from the official date of reporting to work and it does

not include Eid AL-FITR holiday nor Eid AL-ADHA holiday nor

sick leaves


The above clause is written in the contract but now the sponsor is saying this is for an employer not for the employee. I had emailed my embassy and even to labour court but till yet no repose from them. Even I am ready to pay him money if they want but they are saying we don't want anything you don't have any option left now. You can go after 2 years only.

Please help me guys as I am the new hear. The company did not allow me to go anywhere during office time and did not give me leave also because they know I will be going to labour court. After office hour labour court gets shut.

You have the right to take one day leave (Don't go to office on week day). If you are an Indian, please send an email to labour.riyadh@mea.gov.in further if you are residing near by Riyadh go to your embassy. In your absher account also you can raise complaint. You enclose in email or in twitter your passport copy and Iqama copy if you have.

To keep a long story short, the only way you will get the employer to uphold the contractual obligations is by going to labor court.
