Moroccan family advice

Hi,


I am writing to you as my father is a Moroccan national who currently resides in London, I was born in London so I am not a Moroccan national, my father a couple of years ago bought an apartment property in the beautiful city of Kenitra since then he has unfortunately been diagnosed with cancer and wants to be able to leave his possessions such as his property and his money in his Moroccan bank to me. I was hoping you could help me with abit more information on the matter if it is possible for him to gift me his apartment while he is still alive and if so what would this require and how would we go about it? If he makes me the beneficiary on his bank how would I access this? Would I need to make a Moroccan bank account of my own or would I take over his current account? As I am aware I can not input dirhams into a bank account if I was to make one due to me not being a Moroccan resident or would my dad be able to transfer this into it?

Any help or advice would be greatly appreciated.

get your dad to go to the Moroccan consulate with you and get you all the necessary documents stating that he gifted you the things you have mentioned. This can all be done in London.

@Said Idouarab hi are you sure this can be done outside of Morocco, he only has the certified copy of his contract I assume the original is with his notary back in Morocco, would this matter? What sort of evidence/ identification would I need to bring with me? And what other evidence would my dad need also? Thankyou so much for your quick reply. 😊

If your dad has the property deeds and his account details he can transfer this to you via what they call “ laadoul “ which they should have in the Moroccan consulate. Otherwise he should have his will legally done at the consulate. As for the bank account he can always give you check to the full amount or blank but signed so you can fill it when you need to cash it. Whatever needs to be done you should do it while your father is alive and approved by his signature.

@Said Idouarab hi thankyou so much for your swift reply, what sort of documents would I need to bring along I have my original birth certificate with my dad on and my British passport would this be enough? Sorry for my lack of knowledge but does laadoul mean notary? I have tried ringing the Moroccan consulate in London but to no avail, can I just walk in without an appointment?

Concerning my dad's money in his Moroccan bank if gifting his apartment to me does go through would I be then classed as a moroccan resident and be able to have a dirham bank account?

@lyn111  yes you should just walk in the Moroccan consulate in London, they never answer the phone, but once there, they are very helpful.

hi these charges can only be worked out by the notary unfortunately and its calculated at the time of the sale. to get the best answer please consult with a notary who can then check the database of the rate set by the gov. Unfortunately the process can be found out any other way and won't be accurate without speaking to the notary.

Sorry to hear this news about your father, as your father is Moroccan you can apply for moroccan residency yourself you just need your Father "Family Book" that he will have and your birth certificate. Then you can apply for Moroccan ID card and nationality (Duel National) Will make your entire situation much more easier.


As far as Gifting, as its your father your allowed to be gifted the property without or very minimal tax. you would have to speak to the Moroccan Notary to get this done.


For the Morccan Bank account if its a local Dh account without your residency you will not be able to use this account however as mention in my first point its simple process to get your residency if you have th family book but im sure your father has this.


Otherwise you will need to get the bank to give you Power of Attoney document with you will have to legalise and submit to the bank in order to utilise the account wiles your father is alive. If the unfortunate event occurs and your father passes away then you will not be able to continue the account and the money can be taken out with supporting evidence but only in DH which can only be used in Morocco so its better to sort your residency out to avoid any complication and lengthy process.

You would need to speak to the Moroccan Notary in Morocco as they are the only ones that have direct access to the tax database. You can use any Notary in Morocco but if you have access to the same one as your father used then they can easily tell you.
