Hello all! I have a particular question regarding my (future) F card.

I am an Indian, married to a German, living in Brussels. We married in February last year, and I returned to India to start the D visa process. Long story short, my first application was rejected because I applied for a complicated procedure when I was supposed to apply instead for a Visa C under the EU freedom of movement directive for family members of EU nationals. I finally moved to Brussels in October last year.

My registration appointment at the Brussels (1000) commune was on the 6th of November. I was issued an annex 19ter and given the usual instructions of "don't leave Belgium, you can find a job, etc etc". A police verification happened around the second week of December, after which my orange card appointment was scheduled for the 11th of February.

I now have an Orange card that expires on the 11th of May, and the commune told me they still do not know what the decision is on my file so they're willing to extend it for free(?) by a month.


My questions:

  1. Why do they mention "for free? it seems chaotic at their end in processing my documents, and I have not read anywhere about paying for orange card extensions.
  2. I have found a PhD position in the UK starting this October. The position is on campus, so I will need to move there. Do I need to give up my F card in this case? My husband is settled and works here in Brussels, and I will be here at least once a month to see him. It seems slightly crazy to have to apply for a Visa every time I need to see him, not to mention extremely expensive in the long run. I will also eventually move back to Brussels after my course is complete. Can someone please advise me on what is my best course of action here?

Good Day

They will extend for one month which they wont charge you. After the month is finished , you have to apply for family reunion again, then you have to pay 200euros and will be given an orange card again for six months. When you get an orange card you are not allowed to leave the country. I amin the same situation like you.

My man is waiting for F card .His orange card is up on May 6 th .We go to stadhuis to lengthen orange card .


Do they notify if they reject the FCard ?

How is it possible if your file was not approved neither disapproved and you have to pay and start the procedure again?

In your case, I think it was disapproved that's why you need to reapply. There must be always an outcome at the end.

Of course they do as if you were rejected then noway they are going to give the extension to the A.I,. but may give you an order to leave the territory (as stated in their procedure)

Could anyone here still answer this bit? I got my F card a few days ago after yet another battle with the commune, but no one really answered this bit with certainty. Are there any resources I can look into other than a lawyer (that I cannot currently afford)?
