We are a British family living in Switzerland since January 2018 - we are all permanent residents with C Permit status. Our son (18) is going to University in the UK this September and we believe the Swiss would require him to deregister and ”freeze” his C Permit (which is possible for a period of up to 4 years) whilst he is studying abroad.

The issue we face and for which we seek any input is as follows:

With a frozen residency permit, our son will only be able to enter Switzerland effectively as a ”tourist” and he will therefore be constrained to only be allowed to enter into Switzerland for a maximum of 90 days in every 180 days…….so in practical terms if he is back for the summer University break (which is actually 102 days) then he will have to leave 12 days early and more impactful he would not be able to then come back at Christmas……… all of which flies in contradiction of the EU laws around family reunification.

Question - does anyone have any comments,  thoughts, precedence around this issue.

I have already several months ago and they (Bern) were as much use as a chocolate tea cup….they said this is a Swiss local authority decision. I actually held zero expectations from the UK government and my expectations were met - useless. They politically ducked the issue (took easy route out) and nobody in the UK government wants or knows how to deal with the detritus of Brexit.
