Hello,

According to new regulation there is such an update :

... an employee domiciled in the Brussels Capital Region must have resided in Belgium for at least 30 months without interruption and provide proof of 30 months' employment...

If you are domiciled in Brussels then you are eligible for that  otherwise if I were you I would call and ask to 02 204 13 99

Thank you for your reply.

I will try to contact with the number.

Hello,

I am non EEA, I had student job, employment activities are typically covered by a student work permit 20 hours per week. When applying for an unlimited work authorization,  I am considering if the Belgian authorities may count working under student job (not fully), or require standard work permit - single permit only? do anyone know this rule?  many thanks

@maharaji1984 do you know this? thank you!

@Mai Rose

  If your work arose from  your specific situation :

See : Art 10

then i think your case could be counted as half period.

Thanks for your input.

Does this applies if you are domiciliated in Brussels but your employer is in the Flanders?

habtgeb2018

@gafarvictoir

As per info from Brussels capital region office what matter is where your residence is. In my case for example , because i live in LGG , despite my company registered in BRU , i am not eligible.

@maharaji1984

Thank you,  i contacted the BRU office and got all the information. Unfortunately, i am not eligible .

maharaji1984

@gafarvictoir

In this case the period is extended to four years.

If you spent 34 months living in Brussels and then moved outside of it, you are eligible right?

ChandlerBing

Does the new 30 month rule for Brussels apply from when first residence card was issued, or when the applicant arrives based on Visa D and single permit?

maharaji1984

@ChandlerBing

Once applicant registered in commune.

ChandlerBing

@maharaji1984

Is this a different date from receiving the residence card? If so, do you know how to find out this date?

maharaji1984

@ChandlerBing

Yes it's different. Once you registered in the commune you should have an annex 15 or 49. It's your temporary residence paper up to 90 days valid. (this can be extended another 90 days)

During this period your residency card process ongoing.

And in the date that residence card given most probably will indicate validity from the date that ibz approved your residence in Belgium.

To identify this date :

  1. either you can Check your first official registration document (annex 15 or 49)
  2. Or check from mondossier your documents where should stored digitally

@maharaji1984

  Thanks for the detail explanation, I appreciate it.

Strangely I was never given an annex when going through the process of registration, I even questioned them on it but they just continued with my process otherwise which took 4 months in the end.

I will try to get access to mondossier and see. Thanks!
