Hello,

I have searched the internet and forums but have not found the answers to my questions, so I'm taking a shot here.

I am in Thailand now and would like to relocate to Malaysia (Penang area).聽 Could someone please explain to me (or give me some website links) of what is required to set up an on-line business based in Malaysia?
I currently teach on-line and am in the process of having a website developed, with the intent of possibly employing other teachers in the future.聽 Is it possible to establish an on-line business like this in Malaysia?聽 If so, what would the requirements be?聽

Also, my fiance is a diving instructor, does anyone know if he would be able to secure a work permit to teach diving?聽 He is a Master Instructor, with 20+ years and management experience.

If you already have the website and it is generating income for you, all you need to do is to get a work permit in Malaysia. Even if the web site is registered outside Malaysia, but you remit earning to Malaysia and you actually work over internet, you need work permit.

There are 3 things to do:
- register a company (optional but most likely required to next step)
- get a work permit (can be optional as well - depending of details of your business)
- register tax liable in Malaysia

You can rise dividents of your foreign registered company - or even director fees without work permit. In any case you need to be registered tax liable at IRS.

If your online business is generating revenue 100% outside Malaysia, I have a good experience how to optimise your taxation here. PM me if you want to know more.

BTW: in case you are moving here... I would be interested in scuba diving. Have not had time before to start this hobby, but now I think I finally have some free time! So, please feel free to offer your diving lessons when settled here.

Thank you so much for the information.聽 Most of the websites I have visited do not mention my type of situation, and the information that is provided is quite confusing.

I would very much like to live in Malaysia, but I want to make sure that I would be able to do so legally and without having to worry.聽 All income would be from outside Malaysia.聽
I would like to be able to obtain a work permit (and also have my spouse qualify for a visa and then a work permit).

My biggest concern is financial.聽 What would the financial requirements be for me to do this?聽 My company is still at the small/beginning stage, though I expect to be able to expand in the near future.

No problem. Happy to help, I was in same situation and for me it took almost a year to get all things solved

Anyway, you should be prepared for approx 4,500 USD investment, if you let a law firm do all paper work for you, and approx 2,000 annual costs to keep things up (accounting and such. On return you will get really low taxation scheme for your peronal income remitted in Malaysia (not sure about double tax agreement with USA and Malaysia, if you will be anyhow taxed in USA).
