Work permit for dependant

Hi Everyone

I have been working for a Belgium company since april 2020 linked with My head work permit . Hence I traveled  to belgium as a dependant under his contract and found a job here in engineering firm. Now everything flows smooth and no issues regarding my visa stay and work permit . My question is
1) If suppose his employer closing his contract and cancels his rp .
What will happen. Does my  employment  contract will also wind up and need to be move with him .
2) In  this case Is there any notice period it mean time gap  will provide by government to avoid immediate packup .
3) Is  there chances to process individual work permit for me. And what is the procedure  .

Suggestions and guidelines are  highly appreciated.Thanks

Because you are dependent to your "Head" and I assume you are non EAA??? So if your Head lost the job. He has 90 days from the end date of the employement authorization that the "residency" part of the single permit expires.

And its very obviously that you are here due to a link with your Head so... he and you go together.

So, your Head has 90 days to find another job before the residence permit expires that results a "leave" for you two, indeed.

In this time, you want to be not indepent then apply for a Single permit.

Beware, in my knowledge, if you are dependent and want to apply for yourself a work permit. You may need to change the status from Dependent (Family Reu.) to Employee with the application submitted by your employer. This will cost fee and take 2-4 months as easily found in IBZ website for single permit. The employer must do this for you. Check it out!

If you read all the points on IBZ single permit site, you will know the whole procedure. It will also tell you the 90 days I mentioned above.

Hey Renu, You working on dependent visa or got your self a work permit? If work permit then which one? From your question, I feel it's not single permit.

Actually I got an offer from Belgium company and trying to explore if my wife can work there on dependent visa.

She will have full access to the labour market.

As from 1 Sept 2020, a dependent cannot switch to Single permit (i.e change status from Family reunification status to independent single permit holder)  when he/she is already in Belgium (since free access to labour market is already available to dependents now) .

Is it real? There is no such a rules founded in government websites . Only that was circulated by n news paper agency..

Govt will not be publishing in english ... the law is in force and i know cases where the commune rejected the applications. Moreover EY here has published the law that has come into force as of 1 sept 2020

As I already said in another topic, that ey website is way more than suspicious and looks completely fake.

This website is not an official website of the Belgian government/regions and there's no law of the 1st September 2020.

The last review of the exception for work permit has been modified the 2 February 2018:


I did check again the wallonia, flanders and brussels's region website and there's no sign of what you're stating.
Please give us an official link to prove what you're stating.

Well the law is in effect as i know some cases where the commune refused to process chnage of status for a dependent.

I think more than a change of Work permit law, It is more of a immigration law change.

If you go through the points on Ey and other links you mentioned ,if you noticed closer to that points you will get, they didn't done the statement clearly  they were slightley  tried to change the  content at the end .. Government won't publish the rules and regulations like this. They will mention the act changes and the composed point will be clear... I agree your points  that belgian government won't publish in English language.. but if any agency  if they are publishing in english they will attach or highlight the regulations  act numbers which  has been changed .. ..but here they didn't.. and you said you know some cases ( even though there may be some different scenarios.. that employer only need to apply for the changing the status and to process single permit , however the employer will approach any of the consultancy service) they may know the routes..

The only route now is for the dependant  to start working and in the mean go back to home country and initiate the process from there ( if employer agrees to it)... still possible during the corona times where remote working is possible

I am facing a similar issue. My 5 years are ending this August. I was working as expat with CoC for the last five years. My wife is employed and has her own single permit for next three years.
Seems after this rule change in sep 2020, I will no more be eligible for PR card. Does this mean I fully forsake my 5 years of completed stay or can I try finding a local employer and make him do a single permit before my current single permit expires and still be eligible for PR card since I shifted to a local employer when I apply.
