Final Settlement or Leave Pay

Hi All,

Myself gave resignation and moved from the previous employer by giving proper notice period.
However my settlement amount is refused or denied by the employer to pay.
I have a approx 23 days leave left.
There were several talks and emails send, but no positive response.
Would I be able to take my employer to court.

Hi, as I know You can go to court but this is long and expensive process, and during this process You need to be still in Oman. Try to contact with Your embassy first and with lawyer

if he file a case in court he will get a stay order so he can sui but my suggestion is that let it go, you have got visa transfer and thats enough in this pandemic.

Hi,

the employer has to pay all the dues including the end of service benefits to employees. best advice is to file the matter to the Ministry of Manpower, its free, even if the matter goes to court, there is a very good chance to recover the dues from the employer. Yes, employees do not need to be present in Oman during the matter pending with the Ministry or the Labour Court.

Most importantly, as employer terminated, sponsor can be changed without NOC as per the MOM decision.
