Resigning during probation period

GuestPoster08

Good Day everyone,

I'll tell what happened to my employment here first. I've got hired last year Oct. Everything was fine. Then suddenly our company (restaurant) told us that they will be closing the business permanently. So i just work for that company for 3 months. So i had to find a job by myself. And they only give us like 1month and few days to find a new one. They keep on pressuring us to get a request on transfer in qiwa cause they said they will have to close the commercial registration. Then i applied everywhere, i got one request from a company but the offer package was not suitable for me. And then suddenly my company pressured me to accept it or else they will issue final exit. So long story short i accepted the transfer sponsorship 🤧 i know i can resign during probation period, but will it cause me a problem? I want to leave my current company. I'm on my 1st month of probation. And i have a prospect company that offers a good opportunity. What should I do? Will it be possible that I'll get ban? 😢  Help..

@Senjie You can resign from your current employer as long as you are under probation period. Kindly check into the no. of days of probation period agreed between both parties. I guess it should be 60 or maximum 90 days and not longer than that.

Article 81 allows the employee to resign during the probation.

there can be 2 scenarios as below

  1. if employer is willing, he can accept your qiwa right away and you are free to go.
  2. Your employer doesn’t agree and in this case your QIWA request will be auto approved after your acceptance with a short notice period of 3 months by Law. After this time your sponsorship gets automatically transferred and your old sponsor has no control over it.

Your old Sponsor might threaten you by issuing final exit and this is the only option he has in order to cancel that new QIWA request but you have to fight for it in the labor court and decision will be in your favor since you were on notice period.

Good Luck.

Cheryl

@Jadeed Mohammed thank you jadeed for answering , you think it will leave a bad impression if i apply to a new company? And its possible that i will shoulder the payment of the 2nd transfer of iqama right?
