Hello everyone hope am not disturbing, i have a question well might be stupid but will see anyway. My partner overstayed last time he was here and left without problem or notice on his passport. My question is will he be able to come back without any problem? As we want to get married here and wanted to know. Ay help would be great, thank you in advance.

I think only immigration services can provide an official answer but if there's nothing mentioned/stamped on his passport, he might well be safe to come back.

Hello.

When you say 'overstayed', we need more details. When was this, how long did he stay in Mauritius, etc?

As mentioned above, if there is nothing on his passport there should not be a problem.

Aww thank you for your reply, ive asked him thousands of time to check and there is nothing on it. Well lets see as he is coming back next week so fingers cross.

looks like:

  1. He stayed beyond the first 90 days- Did he apply for an extension of his visa?
  2. May to October may be < 180 days but immigration will know the exact date since it happened last year . The system may flag him !
  3. You did not mention his nationality and he may as well been given a visa for less than 90 days initially. Some citizens of some countries are given ONLY 2 weeks' stay>

His passport will have the entry and exit stamp. Otherwise he would not have been able to enter or leave Mauritius.

Does he have more than one nationality? Which passport was he using?

He is from poland and i was expecting them to let him know if he whether he will have problem because of that or not but he said everything was fine when he left and nothing on the passport. We asked for extension but never get a return. We have a son who is born here in Mauritius and he had all of the docs with him so i dunno.

He has also english citizenship and he is polish.

Did you go the Passport and Immigration office to make that request?

That's the only place where the extension would be processed.

Where did you ask?

Both as a Polish ( EU citizen) and a UK citizen he is allowed to stay on a tourist visa for 180 days per calendar yr but you have to apply for that extension at the P&I office

Please check both his passports. Also, was any passport renewed? There will definitely be an entry stamp and exit stamp with dates on one of the passports.

So the dates are there. You have to check if the dates are valid for the stay, or if they do show that he over-stayed without permission. Hmmmmmm.

Well i can see the dates yes but i dont know if they notify him or say something when someone overstay or is there some kind of form to fill? And i wanted to ask also, can he live here as he is parent of a mauritian child?

I would suggest that you both have an honest discussion with the Passport and Immigration Department. You do not want problems in the future.

In the old days, Immigration used to put a cross on the exit stamp and informed you that you would need to apply for a visa to return. I know from experience that Immigration appears to be a lot more flexible with an overstay of 1-2 days, but it’s always a risk. You should get a copy of the entry and exit stamps and the passport and go to PIO at Sterling House and just ask the officers. They will Be able to tell you if there are any restrictions to him reentering the country.
