Evacuating apartment in the middle of the month. Legal advice needed..

GuestPoster455

Moi!
Is it true that in Finland you have to pay the whole rent for a month even if you evacuate in the 14th? I have informed about leaving the apartment 1 month and a half before the evacuation date, exactly as the contract states?
My landlord demands the whole rent because, as he says, this is the law in Finland.

Yes, Vertigo, that is the law. You always pay rent until the end of the month following the one in which you give notice.

So if you gave notice in June, whether June 1 or June 30, you pay rent until the end of July. You may, of course, evacuate already before that.

Exceptions are possible, notably if you have especially defined in the contract that the tenancy month starts in, say, mid-month and ends in mid-month. In that case, you would pay rent only until day 15. (Notice that if you then wanted to stay until day 16, you would be obliged to pay rent until day 15 of the following month!)

If there is no such special clause in the contract, it is assumed that your tenancy month begins on the first day of the month and ends on the last day. Thus, you pay rent until the end of the month.

I am surprised that you say your contract tells you to give notice 1.5 months in beforehand. A clause like that is not legal. Are you quoting it accurately? The law on giving notice is always as I explained above, and no contract can change that. In your case, of course, it makes no difference.

Thank citizen1 for such an explanatory reply.

Yes my contract says that I have to give notice 1.5 month before, and so did I. I also was surprised by that term when signing the contract, but I had no other choice because I had to move in quickly and this was the best option at the moment.

Anyway, I am relaxed I got this clear, because at least I wanted to be sure I am not get ripped off. I could not find much on the web and whoever I had asked was not sure about that (possibly no one had left an apartment mid-month)

kiitos
