B Work Permit Application Process

Post new topic

Indeed, the vacation period plays a role - ministry's backlog gets bigger and that adds to the delay. Websites will tell you the theoretical (ideal) timelines. Practical results always depend on the workload of the ministry.

Hi Aneesh,

Need one more help !! Can you please help me with Tax in Belgium and is 3000Euro/month enough ?

Sandy

3000 net or gross ?

Gross to net calculation - Read:

Living costs: /forum/viewtopic.php?id=652395 (and more research on google).

Rest is math :)

Temporary foreigners residence permit : [work permit B]
1. Time frame to apply and receive the RP ?
2. Can't we work without receiving it ?
3. Does it impact the Payroll until we receive it ?

-1 --> 6 months
-2 --> NO
-3 --> No work allowed means no money...

1. If you meant Work Permit, it is applied by your employer to the labor ministry. Normal processing time used to be 3-5 weeks, but nowadays due to workload (I assume), it takes upto 3 months as I heard (there is no definitive timeline). If you meant RP (residence permit), it depends on the commune you live in. Some communes (like 1000 Brussels for example takes a long time - again, high workload there and lot of expats) - Otherwise, it takes a month to two max to get your residence permit once you do the inscription.

2. If you have a WP, and you did the inscription for RP and waiting for RP, you can work. You cannot work without a WP or with an expired WP.

3. Again, if you really meant WP, as mentioned in the above comment too, employer is not allowed to engage you without WP or with an expired WP. It depends on the employer how they handle the payroll. Do check with them.

sandym007

I do have a work permit(WP) and have applied for the residence permit(RP) in the commune.

Just wanted to know whether my payroll can be started or not without residence permit ?

aneesh

It can be started (as you did register and now waiting for the RP). When you get your residence card, inform your employer, give them a copy. If you already got your national ID number, give it to the employer. Else, once you have it. This is normal that all new employees when moving from a different country, will take time to get their residence permit.

sandym007

Thank you Aneesh.

happy to know that payroll can be started without receiving residence permit.

This is to be done by your employer. This is the process for the employer declaring a new employee to the social services.

sandym007

Hi Aneesh,

Thank you for your earlier response.

Does DIMONA declaration needs to be done on the first day of office?

1. Is there any deadline to declare this by the Employer ?
2. Does it needs to be done before applying for Residence Permit ?

Read more here:

More official info available in the websites of concerned ministry (google will get them for you)

As I said this is totally employers responsibility. And HR or payroll department knows very well how to handle this. It is not for the employee to work on this.

Hello Aneesh,

I have a simple question, my WP was approved on 21st March but I have not received any information from my HR about the same & I directly contacted Belgian Werk Department to know the status of my WP application & got to know that they approved it on 21st & the same can be collected from Commune from 26 March onwards.

Now, the issue is that I tried to get the appointment for the same from commune but due to heavy rush the first date available for âppointment is of 31st March, now my question is that my previous limosa is still valid but work permit has expired but now I have the telephone confirmation from Belgian Werk department that they already approved my work permit & it just needs to be collected. Am I authorized to work within this period, say from 26 March until 31 March the day when I will actually receive the hard copy of the WP?

Ankur

sandym007

Thank you Aneesh,

I went through the link and googled for other kind of info. Couple of queries more !! if you can share your expertise it would help :)

(A). Dimona Declaration needs NOSS number :()

I think NOSS will be provided after applying for residence permit in Commune and post police verification. This process takes time at least 1-2 month (approx) . Hence

A1:-Can Dimona declaration is possible without Employee NOSS and can be updated later once employee receives from commune?

A2:- is employee supposed to work for the employer without having the NOSS or if DIMONA declaration hasn't been done ?

A3:- Is there a way employee can verify the Dimona declaration ?

(B) Any info on LIMOSA and PARTENA declarations ?

aneesh

A1-3: This is all the work of payroll and HR department of your company. Not something the employee needs to worry about. And I personally don’t have any more info on this. May be someone else here has.

For mutuality registration, you need your residence permit. So just wait :)

sandym007

Hi Aneesh,

Good morning !! how are you doing ? Need a small favour again ....it's been over a month and police verification has not yet been done for my residence permit(RP).

Can you please suggest what to do in this situation ? my payroll is getting delayed because I don't have the national number ?

Regards
Sandy

aneesh

You have to wait. Somethings you can do in the meantime - You may go to the commune (townhall) and check if they passed your file to police. if not, then request to speed that up. If yes, visit the police station and check if they made a visit and you weren't there or so (normally they drop a paper in your mailbox, but sometimes it can be misplaced), or request if they can do the verification by explaining your situation.

And, your payroll does not need to wait for national number to start giving you salary (they can update the number later). However, if your companies payroll process or systems cannot start disbursing salary without updating national number, then bad luck - only way is to wait.

sandym007

Thanks Aneesh,

But surprising to know payroll works different for different companies ? Some companies can start payroll without national number and it's required by some other companies.

aneesh

For me it is logical. It takes sometimes even 2-3 months or even more for a person to get his residence permit (& national number). His/her salary must not be held back for this period.

sandym007

Hi Aneesh , Agree to your point .....salary should not be held back.

Hi Aneesh,

I am a software engineer currently working in Bangalore. I got an offer for Belgium, hence they initiated the process to issue a WP for me.

#1 Its been more than 6 weeks since my employer applied for a WP in Brussels region. Any idea, how long do I have to wait or is there any way to expedite the process?

I understand there has been some delays primarily because of the following reasons mentioned in the link below.

#2 Are you aware of any kind of WP tracking link?

#3 How long does it take to get the hard copy of WP after the soft copy is issued?

#4 I will be applying for long-term Belgium through VFS Bangalore, any idea how long will it take to process my application?

Thanks in advance!

aneesh

1. Now there is a huge delay in processing of work permits. One can do nothing but wait. There is no way for the employee to speed up the process. The employer (or their agent) can contact the ministry and see if anything is possible.

2. No

3.  Depends. Approval note of the first WP will be sent to the local commune where the employer is located. Your employer (or their agent) will go there with your photographs, etc and commune prepares the hard copy work permit and hands it to your employer/agent. Upto 2 weeks after the approval is a realistic timeframe.

4. A week normally if your file is perfect and all documents are 100% ok.

aneesh

I remember someone asked question on social security registration.  This is to be done by the employer - but if you are interested to learn more on this topic, here is a useful website (official):

bbasu

Thanks alot Aneesh for your response!  I will reach out to you in the future for any queries.

I guess I need to wait a bit longer to get the WP.

sandym007

Hi Aneesh,

As an Employee do we need to buy any insurance plans in Belgium ?

I am covered for the below insurance by my Employer :
a. Work accidental insurance
b. Medical Insurance

aneesh

Read through both policies and list down what all is covered. List down what coverage you need and there you go :)

bbasu

Hello Aneesh,

[Update]

My WP is now ready. I should get it in some days.

While booking for Visa appointment, I can see a lot of Visa Type option for VFS Bangalore. Can you please confirm whether I should book for "Long Stay" or "Long Term" Visa? Also, "Long Term" Visa does not have any available dates in the near future.

I have a Type B WP and looking to book a Type D- Work (more than 90 days Visa)

TIA

aneesh

Long stay should be fine. Call VFS helpline for confirmation.

Zohrakh789

Hello Everyone,

hssn601

Anyone knows about latest processing time for work permit?

My employeer applied for the work permit on 26/04/2018, will let you lets see how long it will take to process :)

Elancore

1 week in my case since applying day till approval.

sandym007

Hi Elancore,

1 week for renewing existing work permit  OR you got your very first work permit for belgium in just 1 week ?

rayhk86

Hello Aneesh,

I am Harsh. One Agency  in Belgium applied work permit B on behalf of my prospective employer.
They said it will take 3-4 weeks, However when I contacted them they are saying work permit is approved but it has not arrived town hall. One week ago they said work permit is approved and it should be available in town hall.

It was applied on 18th April 2018 and as per them they received a letter stating that work permit was approved on 8th May. Still it hasn't arrived town hall and it might take 2 more weeks.

Kindly help.  I am little worried as I have resigned from my current job.

aneesh

You or the agency may go to the commune and ask. Sometimes it arrives there and due to workload, they don’t send the agency the notification on time. Don’t worry. If it is approved then the main step is over. Now it is just a matter for commune to print and stamp the Work Permit.

elifsadaakaslan

Hello All,

My process took like 2 months and a half. It's really long. But they informed us this is not personal or related to my company. It's due to the high number applications and lack of staffs.

FYI,
