HELP need to change the mother's surname in my son's birth certificate

Hi,

Please HELP me!

I am a Filipina, staying here in India, married (but not yet registered) with an Indian.

We have two sons, first son was born in Philippines (his birth certificate has no father because he was born when i was still unmarried and his father couldn't go to Philippines to sign his birth cert.) anyway, that's not really the problem.

second son was born here in India (we got married already before his birth) my husb and registered his birth cert. writing the mother's name using his surname (because we are married) expecting that our marriage will be registered.

But after 9 months of staying together, I realized I don't want to register the marriage anymore. I have a lot of reasons:
1. Culture differences
2. He is always drinking
3. Irresponsible father and husband
4. He is hurting me mentally, emotionally and physically just because he is upset that he is jobless and he can't get his part of their land (his family is not accepting me)

Now, I need to go back to Philippines with my eldest son, but I want my youngest son also. He can get married again with another woman and he can have more babies. But me, I can't get pregnant anymore as I undergone tubal ligation while giving birth to my youngest son via cesarian section.

I can't take my youngest son if I can't change the mother's surname in his birt cert.

He is not cooperating with me. He just want me to get lost. We lost our respect and love to each other. We can't fix it anymore.

Please help me. What will be the process?

2nd option is your child donate in orphen school

Do NOT send him to an orphanage. He will definitely be sold into a human trafficking ring
/sexually assaulted and neglected.

Worst case scenario, you and both sons file for expatriation and explain the situation. Your embassy should also be contacted.

Please, please, please do not leave your children in an orphanage. You'll lose them.
