Hello everyone,
I need advice on how to proceed with beginning my application  with the Police Federal in Sao Paulo or wait for the arrival of the FBI document apostilled by the state department.

I am American married to a Brazilian living the last 9 years in USA with her. We decided to move finally to Brazil.
We are both 63 and retired. Sold our home in Florida and finally made the trip arriving Nov 1st.
I have all our papers to apply but still waiting for the FBI background to be Apostilled by the State Department.
The State Department received my doc Oct. 8th and at that time there was no warning that are falling behind on Apostilles. Couple weeks ago I found out that they are running 2 Months behind because of COVID and the elections!! A process that usually takes maximum one week to be processed!

Should I go ahead and try to apply and on the interview tell them my problem or just wait for the doc and try to extend my tourist visa which expires at the end of Jan 30th?

Both of us are confused on how to proceed please advice if you can!!
Thank you so much
Dimitrios and Cecilia

P.S. we intent to use an agency to schedule the appointment with Police Federal and assist us with the interview.

Dimitrios,

Under the circumstances, I would try submitting the background check as-is, and not say anything about an apostille unless they do.   If they ask, tell them that the US Dpt. of State is backed up months on apostilles because of covid.

I’d be a tad leery of despachantes when it comes to this; various folks have told me that they still haven’t been able to make an appointment with the PF; however, your results may vary.

I would, however, still go ahead and try to make an appointment.  I was informed a week or so ago that they’re currently about 90 days out.

I did a second FBI background check in August and received it 3-ish weeks later, only to find out that documents issued during the suspension of visa requirements would NOT expire until 21 March 2021, *if* you do not leave the country.  (Basically, I’m sitting on two valid documents, either of which I can use)

The PF does have leeway regardless, as to whether or not they will accept documents issued outside the 90 day window; given the state of the pandemic, they’ll probably accept your documents as long as they’re apostilled and translated.

Hi, thank you so much for your reply! Yes I agree that as things are right now I need to go ahead with it and God help us!

Thank you for your reply! My wife is also very concerned with despasaches too! We will go ahead with submitting the paperwork and God help us!
If understood correctly at this point there is a 3 month for getting into the list for an appointment and I am covered on not having to leave Brazil if I have a scheduled appointment with PF?

Try not to stress about it too much while you're waiting.  Remember, your wife has a right under Brazilian law to bring you into Brazil to live with her, and a retired gentleman in his 60s is not a person that the Federal Police is looking for reasons to exclude.  If anything, quite the contrary.  :top:

Hi -

My husband just got a retirement visa for Brasil, and a month or so later I got the family reunion visa based on his retirement visa.  We used a company out of SP to facilitate the process, and they were excellent on knowing the ins and outs of the process, as well as setting my husband up with an appointment with the Federal Police to complete everything.  We thought it was a good value for the price we paid.  They gave us a proposal for all of the costs ahead of time, and everything worked as planned.  Here is the information should you want to pursue this path:

Hi all: I finally have all req docs for spousal application. I filled out the form & received an agenda number. Do I wait until they contact me to set up interview or should I email the signed application to them requesting an interview? Any help on how next to proceed will be welcome.

I would never wait for the Federal Police to reach out, unless they've stated expressly that that is the next step.  The fastest way to get an answer is to call them, tell them that you've filled out the application form and have your documents ready for review, and ask them what the next step is.

If São Paulo isn’t going to be your resident. It maybe easier in a smaller town. This was my experience got my permanent residence in a small town went very easy with PF. Didn’t need FBI report did have a local police report from Las Vegas police.  They accept this but didn’t seem to important. Nothing I gave them was Apostilled. Just a thought for you to consider

I am no expert, but I have been going in and out of Brazil for about 15-years. We own an apartment in SP, have had my CPF for a decade, have my VITEM XI, my CRNM appointment in SP is in 10-days  Yes, I am white, but my Brazilian wife is black.  I have not witnessed or heard of any racism with regard to the Police Federal or in any of Visa processes, whether in Brazil or in the US Consulates. I am originally an immigrant into the USA, and I have helped about 6 other families with US immigration.  Immigration and the paperwork for the USA are much more difficult and takes a huge amount more time than any of the processes in Brazil.
