Am I a Tax Resident or not?

Hi Guys,

I have recently obtained my Employment pass - i was previously on student pass. I didnt need to exit and i have been in malaysia since June 2019 until now.

Am i considered a Tax Resident or Non-Resident?

How can i check on that?

Technically, yes.

Will they enforce it prior to this year? Probably not.

183 days in any calendar year in Malaysia makes one a Tax Resident.

If you made no income then you have no taxes.

But presuming that you don't leave before July you'll accumulate that amount this year and you would be taxed at the rate for "Tax Residents".

It gets complicated for the previous/future year presuming that you don't meet the standard days...but there are ways to carry over the residency status. Ideally you should not take more than 15 days away in that future year (if you don't meet the 182 day residency). Complex.
