IBI owed by previous owner

Hello Aida,

We bought a house in Málaga province in 2010. We did not check at the time that the seller had fully paid their property taxes such as IBI before we bought the house. Are we liable for any unpaid taxes on the property prior to the time of our purchase? We have, of course, paid everything due since 2010.

My understanding is that IBI arrears should be paid off prior to sale. But once you complete the transaction at the notary, it's a done deal, and there's limited scope to take action against the seller (and even less after all these years).


When we purchased our flat in Alicante, the IBI arrears were checked, and this was deducted from the purchase price (instead of paying the IBI bill directly, as the owner was abroad). When we went to check the IBI situation, they gave us a statement with the figures for the current year, and the arrears for past years. My guess is that the same would have been done with your house, so if you didn't see any arrears on your bills, there probably weren't any.


Or, if you prefer, just go get a statement of your IBI and have them confirm (or otherwise) that there are no arrears.


However... I'm curious why you've started worrying about this 13 years later? :-)
