Looking for fastest path to be together in u.s.

First question I have, is there such thing as a girlfriend / boyfriend Visa? I know that a fiance visa exist? I don't know if it was just a translation error or if there is such thing as hey girlfriend / boyfriend Visa. It keeps getting mentioned in videos explaining the process and visasa....What type of Visa would that be? I know that a B2 Visa is for tourists and they K1 Visa is for fiance, but I never heard of a girlfriend Visa before now. I was just told that the fastest path to be together here in the US is for me to marry my girlfriend in the Dr first and then do the application process, would that be true?

Also, does it work against me or cause complications if I had a previous fiance visa application that I then withdrew? It was not too long ago to be honest, i was too upset and frustrated to go online and withdraw the application, next thing you know suddenly it was finally approved and with the nvc....it didn't not go any further than that, no intervirws, etc. Just the intial approval and thats all. But I sure don't want to talk about the experience, so please pardon me.

Oh, I should mention that there are children involved, they are her children, so how would that factor into things?

planner

There is no boyfriend/girlfriend visa.

There is no fast path. Everything is very very slow!

It likely will be held against you that you recently had a different application and withdrew it. They look for any and all red flags.

planner

Wrong word,. Not withdrawn just let go!

Oscarsahony Sanchez

yeap. very strict when it comes to filling apps just because, as Darlene said (red flags)

Shestheone

@planner

Ah great...there goes life interfering again. When did people get to control our happiness so much?? Can't marry, can't visit, waiting for separation, wait for.divorce, so much they make people go through...when nobody is promised tomorrow. Smh.

planner

I guess there are consequences for everything we do.

Shestheone

@planner

So, I understand that it will seem like a red flag to them but does that mean that I will get denied right off the back or will they at least speak to me and ask me about the situation? Well I have a chance to defend their suspicion? These are all legitimate feelings, actions, Etc so I have no problem explaining things but will they offer that opportunity? And if I do get denied how do I move forward after with trying to do the petition is there like a penalty waiting time after or some other sort of consequential punishment? Also, because supposedly even though all pass along supposedly it is a little bit shorter if I get married in Dr first and then do the petition I may end up going that route. So if I do that, and then filed the petition will it still seem suspicious to them or anything like that? Or will I be denied possibly.?

WillieWeb

Im not sure anyone can answer  those questions

for the government

planner

Like Willie said, no one can effectively speak for the US govt.

What I have seen is they don't care about your explanations. You have red flags it's rejected. You can reapply as many do. Many get rejected several times.

Reality is few get approved for a variety of reasons. One reason is shear volume of applications here and around the world. I assume they manage accordingly.

Shestheone

@planner

Just great, sounds like I wasted my one good shot on the wrong one, oh joy😫.

Not caring about reasons or explanations?? Yup, sounds like our government alright., smh.

planner

So honey  you may not have wasted anything. We are talking in generalities here,  what it has been like.  Your first shot may not have worked either!  There are a lot of variables at play here.

The reality is they cannot possibly take the time to listen to every explanation and story. In this you are not unique, everyone has a story!

My wife came to America on a visitors visa since I had planned on retiring and moving to DR until plans changed.

Any way we filled out the paperwork sent in all documents in duplicate since one form goes one direction and one the other direction along with two separate checks .Oct 2017 Jan 2018 We had her green card .

Remember you have a certain amount of time to supply additional documents if requested if not  Oh well 1500$$ down the drain .

planner

Remember things changed during covid and much has not changed back!

Shestheone

@planner

They had approved the 1st time around after providing additional info. But approval came after breakup and before withdrawal of application. But...as you're basically saying, I won't get deterred completely, I will try anyway, nothing else I can do, right?? But, do I have to pay for each re-attempt also. Hopefully there's none.

The approval I speak of is the 1st step, it then went to nvc and that's where I requested withdrawal. I jad to send in a written notarized letter and attach to their public inquiry form online.

Shestheone

@Dewayne Stevens

2 separate directions? Can you elaborate please? 2 checks, and $1500??? Definitely please elaborate lol. Ouch! I like the time frame however. But my partner does not possess any visa currently. But it would be great to see that type of time frame, lucky you. Good for you two🙂.

Visitor visa is 247 days right now. They make it so hard for someone to visit us, and to turn a 1 adult inco.e household from.1 to 2, lord knows people need 2 nowadays.

planner

You pay each time you apply.  And all the paperwork has to be updated each and every time.

Shestheone

@planner

That's ridiculous.....

Thank you. So will it matter that this time around the circumstance will be different from the first? Meaning, the first time around I was unmarried and looking to get married and petitioned for a fiance visa. This time I'm going to go a different route and do the marriage first and then petition for a spouse visa. Does any of that that make a difference in this case?

rlwoodz

@Shestheone the US govt will force you over time to prove the marriage is real prior to granting a spousal visa.  You'll want photos spanning prior to, the ceremony and after. It can take a couple years. You can thank people for fraudulent marriages in their desire for US citizenship for this major inconvenience.

planner

Reality is I am not inside the American embassy.  I just don't know if it will matter.  Their attitude seems to be - prove it's real!  And they have good reason for it.  The horror stories are never ending.

ddmcghee

My ex was a naturalization officer in the US - he's since moved on to other areas at DHS, so he can't answer any questions on the current timeline/procedures/etc. He wasn't responsible for visas but for the process of green card holders applying for citizenship. The number of fake relationships that actually made it through the visa and green card process was unbelievable! Immigrants from a number of countries are notorious for conning people into these "relationships" and even marriages. Unfortunately, the bad eggs are the reason for the extra attention and scrutiny in the process.

Shestheone

@ddmcghee thank you.

😮â€ðŸ’¨ðŸ˜”...well, thank you each for your responses. Finding love ain't easy, so that should be understood by them as well. But who am I kidding...

I might as well ask the things I need now, certified divorce (previous years) paper, certified birth certificate, and passport?? Do these need to be apostilled, and here in the US?

ddmcghee

If you are talking about the documents needed to get married in DR, check out the pinned thread on that topic. Much of what you need will be there.
