Immigration question, please help

American, every year I visit Quito for 5 days end of Jan and leave beg of February, never had trouble before, in 2024 I arrived Quito 1/29/24, left 2/4/24, now in 2025 I arrived last week 1/30/25 and left yesterday 2/3/25 and at airport immigration gave me a demographer sheet with none of my info on it but wrote $235 which they say I owe for overstaying, said there is a cycle of staying and mine was 1/29/24 to 1/30/25 and since I was still in country on 1/30/25 (the day I arrived) it meant I overstayed and am fined, said I must get lawyer to pay in Ecuador to their bank or I cant come back for at least two years, said I can complain but did not tell me where, the form they gave me UCM-AIMS-UIO, Notification de Multa, TIPO see Sancion: ART 170 Nro. 2a LOMH,

Can anyone explain this to me, I am a tourist not resident so do not understand.  I do have dual citizenship so may just go 2026 on my Irish passport, but who do I complain to, thanks Kevin

Each Country has their own calculation Process. Have you read the Law ? You do not need an Attorney.

(Note: I'm not authorized to practice law in Ecuador so this is not legal advice, merely my lay opinion)

Assuming your description is accurate, it would appear there's a mixup where the immigration official(s) believe you did not leave the country during 2024.  In any event, according to either your passport or their system, you were in the country for between 366-370 days while you were only authorized by your tourist visa to be here for 30.  My guess is that your departure on 2/4/24 (Ecuadorian date 04/02/2024) was either not entered into the online database, not stamped in your passport or both.  Assuming all your entry and exit stamps are in order in your passport (you should be able to check for yourself), you should be able to solve this eventually by going through the proper channels.  And if you plan on returning to Ecuador, I'd get it solved: Immigration infractions can often be cause for denying entry into a country.  Would highly recommend retaining a local (Ecuadorian) attorney with experience in immigration issues.


Edit: Just reread and realized you are outside Ecuador.  As it stands, you'll probably have to get apostilled copies of every page of your passport and mail those to whatever attorney you hire.  He or she will let you know what they need to start the process - assuming they can start the process without you in the country.  But I wouldn't plan on returning next year unless you get confirmation this is cleared up from a competent attorney.  Also, navigating government bureaucracy here is like wading through molasses so don't expect a quick (highly unlikely to be days, probably months - maybe years) resolution.
