Notice seniority: date of resignation or the last day of work ?

Hi all,

I am in a process of changing my employer in Flanders region.
My start date with my current company: 7 September 2020.
I am planning to give my resignation: 19 August 2021 (Thursday)
My notice period will start: 23 August 2021 (Monday).

My question is, how long is my notice period? I know it depends on how long you work (seniority), but I am confused with the 'end date' of the period. Is it the date that I submit my letter of resignation (19 August)? Or, is it my last working day (September 10 or September 17, depending on notice period)?

Because, if the end date for seniority calculation is the date of resignation, then I will be working between 9-12 months, so my notice period is 3 weeks. But if the end date is the last day of work, then my seniority will be 12-15 months, so my notice period will be 4 weeks.

Generally your notice period starts the day you officially give your resignation letter, unless you state otherwise in the letter itself. The letter should also contain the date of your last day at work (end of notice period). Atleast I did it this way, when I went through this process.

For the duration of the notice period, best to check with your manger and HR.

It depends on what the company policy is and also if your manager would like you to handover certain tasks which take time.

Actually, my question is not about the start of the notice period. I know that it starts the first Monday after the resignation letter submitted.

My question is how seniority ('length of work') is calculated, as I will be finishing my first year during the notice period.
