Outside Singapore now, EP not renewed, what next?

Post new topic

singswan

Hi, my question is a little different, that is why I am starting new thread.
I am on EP in Singapore, but current living in India. My entry permit has been rejected many times by MOM. I am still working from home.

My EP expires in March. According to MOM, my employer should cancel my EP if I am not in Singapore by that time.

Question: Will I lose my job if my employer cancels the EP? Or, can I keep my job and continue working from home without EP (assuming my employer wants to keep me) and go back to Singapore later when I get EP and entry permit again?

Hi Singswan

Unfortunately yes, you can't work without EP but if your company has office in India, you can get transferred to its payroll and work.

HI Bindu25,

Thanks for your answer.

For reference:

For pass holders who are unable to return to Singapore to have their passes renewed, please cancel the passes and re-apply for them when the COVID-19 situation has stabilised.

A related question: What will be my status between "the pass is cancelled" (e.g. March) and "re-application" (e.g. June)? If the employer is allowed to re-apply, then perhaps I still have the job after EP is cancelled? Isn't it?

Thanks again for your help.

You only need an EP to work in Singapore.
Working remotely (from another country) for a Singapore company is not under Singapore jurisdiction, but under that country's rules. So check what the employment rules are in your country and clarify with your employer whether they can and want to keepyou as remote employee.
Since the Singapore employment contract is not valid abroad (and ceases to be valid when the EP is cancelled), you need a new (foreign) contract then.
(Remark: Most likely you won't get a Singapore salary when you work in India.)

Sorry to ask this again but I am getting nervous due to the uncertain situation and hoping that somebody might be able to provide some clarity.

About EP renewal by employer, from the MOM website:

Without a valid EP, your status is: Not employed and not resident in Singapore.

Without a EP, your status is not employed at Singapore
