Leave encashment

Dear All,

My company has Leave encashment policy .
However I am working on Dependent visa , My wife company contract is going to end .
I have 2 months of notice period but I'm not eligible to work with LOC after 1 month as my wife EP get cancelled.

So whether my company has right not to give leave encasement amount? As i have informed same before 2-3 months

Can  I check with mom on this?

I understand that you are holding a DP and work with LoC?
If so, your employment automatically ends at the same day and time as your wife's.
What outstanding salary or other payments you are entitled to at that time (or which penalties might occur due to not giving sufficient notice) is solely between you and the company and normally defined in the contract (check yours!) - MoM will not help you with this. If you cannot find a mutual agreement with the company, a court would have to decide (i.e. you'd have to sue them - which is not advisable!).

Ok thanks Beppi. May be I only check with HR and request them as no such scenario mentioned in my contract. Only accrued leaves will be enchased is mentioned.

So I will leave encashment amount as I don't want to create any problem for me or nor my company.
