DP holders cannot work on LoC any more-will have to secure a work pass

In a major change, Dependant's pass (DP) holders will soon have to secure a work pass instead of a letter of consent if they want to work in Singapore, the Ministry of Manpower said on Wednesday (Mar 3).

The move is to align the requirements with other foreigners working in Singapore, the ministry said in a factsheet.

Companies that hire DP holders will therefore have to comply with the conditions for hiring foreign workers, including the relevant qualifying salary, quotas and levies.

From May 1, DP holders will have to apply for an applicable work pass such as an Employment Pass, S Pass or work permit rather than the letter of consent that they currently use.

Those working on a letter of consent will be allowed to continue working until its expiry. After that, employers will need to apply for a work pass.

DP holders working in Singapore with a letter of consent make up about 1 per cent of all work pass holders.

Hi Surya,
I'm currently on DP and working on LOC ...my husband's EP and my DP are under renewal due to change in entity within the same company. My current LOC is valid till next year but I also got to know that my employer will have to cancel my loc and reapply a new one. I wanted to understand is there a way by which I can renew the LOC based on my new do as the Fin number will not change. Any idea about the validity of new loc?

This rule will be imposed starting from May 1. So, before that any renewal will not be impacted. You may double check with your employer. Good luck

Hi...my new employer applied my loc on 2nd march , just one day before the new came...and now it pending for approval on mom site....is there anyone who got approval after 3rd march?

Does this new rule affect the chances of employment?? I am on DP since 2017. Haven’t started applying for jobs..

Sruthi06: It is applicable when a DP holder will try to find a job. Currently, LOC was enough to join but now employer has to apply work pass for the DP holder (no LOC from May 1).

Thank you Surya. Its just because I doubt if employers issue work pass to foreigners staying in Singapore as there are conditions on dependency ratio as well as  levy. Also heard that with the new rule, the chances of getting jobs may be far less compared to getting jobs through LOC. So quite concerned about what shall be the consequence since May 1.

Yes, certainly it will be difficult but it depends upon the sector and the job position a DP holder is applying for.
Secondly, employer has to go through the current procedure in place such as show the ad in job bank for 4 weeks then show the proof that employer tried locally but couldn’t find a suitable candidate etc.

In a positive note, most of the cases LOC holders salary was not in line with market standards. Further, working security was not there as anytime if a DP holder’s sponsor lost a job then DP holder job security is in danger. So, getting an independent workpass will have both positive notes.

LOC can be applied but it will be comes under the new rules if by May 1, your LOC application is still pending. Chances are likely that it may be approved before that. Good luck

Hi suriya,

LoC Application submitted on March 19th 2021. But the status is still pending. Is it possible to get approve before may 1st or it will get rejected. Please let me know the possibilities.

Chances are very unlikely that your LoC gets approved now, there is a possibility that MoM held back such LOC for the same reason that employer will apply work pass after May 1. Good luck

Ya 3 days left only but why you said chances are unlikely?
If MOM wanted to, they may already approve but set the outcome only out on these days, even on Apr 30th. If they reject they can put reject status anytime already no need to hold...

You are free to share your thoughts so as I’m. That was my observation. If MoM wanted to approve someone’s LoC then they could have done it much earlier.  If you are getting your LoC in next two days then you are really lucky. Good luck

Why would MoM reject 100s of applications, which would be additional paperwork, sending emails to the employers and so on? They just hold it till Friday then after these applications are no longer valid as LoC criteria is nullified.

No paper work needed.
Guess they can set their system to release outcomes at specific time. Webside will update results, emails will be sent to employers when time comes, as normal. Not so high spike of applications that makes MOM change the normal work they are doing.

Ya just don’t lose your hopes until 30th.
I know some applications got approved recently

The way you are describing as if you know all the insiders including how many applications are pending and how MoM works. Then no point of discussion.

We have different views. You also said that MOM simply holds the applications until May 1st then they no need to work on it. Why did you think so 🤔 then?

I just described what we observed from MOM/MOE once outcomes released. The status changed at anytime (not in normal working hours). Mine come in early morning, or late afternoon, or massive MOE results released at 8-8.30am. So I think they set the timing for outcome released in their system. What we received is just the new status of application on website and an email with pdf letter sent to HR which is easily to set up automatically from their system. Nothing else, no physical letters were sent.

Of course from my reply above I stated that I “guess†so. So peace!

In this circumstance no one can tell anything precisely, I just guess based on what observed so far. Prior to this May 1st announcement, MOM is still receiving LOC applications as normal. On March 3rd they announced new policy, do you think many employers/DP candidates can manage to match jobs and apply LOC and make the numbers increase that much? And how many current EPs can be renewed in Mar and Apr just in time to apply LOC for renewed DPs? Not so many to say a big change la. In fact, once the announcement came, job advertisements started to remove DPs from the required candidates. Employers don’t want to waste their time...

Of course MOM may ignore new LOC applications and finally rejects in this time, have to accept that fact. But it might be MOM delayed tactic to release outcomes only in Apr end to reduce number of incoming applications.
We wait then 😊

MoM doesn’t send physical letters. I said paper work which means processing of an application, reviewing each documents, verifying its authenticity, sending documents to different sections of MoM for their approvals etc. I’m NOT referring physical hard copies nor saying physical letters to send. So, understand it correctly.

I know MoM updates EPONLINE middle of the night, weekend or any other time because it is not updated by individual officers. It’s a data feed which are done through batches.

I don’t say something just like that. My observations are more than 10yrs where 7yrs having involvement in this site as a volunteer. So, my response was based on past observations.

I updated on 27 not yesterday. Result came in early morning yesterday.

So don’t lose your hope till the end.
Of course should ask employers for plan B

Sruthi: This means they don't want to apply for a work pass, so you are not a suitable candidate (because you cannot work on DP and thus need to change to a work pass). Sorry!

In both the cases of an employee with a work pass and a DP with out work pass, the employer has to apply for a pass. So I am confused why this statement. Is it because with the new restriction, employers are less willing to apply for work pass?

Hi,
You are right that in current situation, employers are not willing to apply work passes for employees, due to many reasons (quota/cost/gov restrictions...).

Foreigners are allowed to work in Singapore only if they have a work pass, and employers have to apply it for them.

For the statement you concerned, it means that this employer just wanted to hire only Citizens or PRs/LTVP only (as they have rights to work in Singapore).

Sruthi, still there are jobs that employers can apply Epass or Spass and if you are in Singapore then you have more chance compared to overseas candidates

It all boils down to quotas a company has, your skills that differentiate you as the better candidate and of course the other parameters like company profile, salary etc. There are jobs, a lot of them, market did open up. You just have to find the appropriate one and interview.
